Right to access information

Based on Article 3 of the Law on the Right to Access to Information (Official Gazette, No. 25/13), the right to access information for natural and legal persons is regulated through the openness and publicity of public authorities.

The right to access information and reuse of information includes the right of users to request and obtain information, as well as the obligation of public authorities to provide access to the requested information, or to publish information regardless of the request made when such publication arises from an obligation specified by law or other regulation.

The right to access information and reuse of information is regulated and exercised in accordance with the Right to Access Information Act (Official Gazette, No. 25/13). The Act prescribes the principles of the right to access information and reuse of information, limitations on the right to access information and reuse of information, and the procedure for exercising and protecting the right to access information and reuse of information.

 

Information Officer

Municipality Milna informs the public via the official website about the documents and information it possesses that are publicly available in electronic form and can be accessed without making a special request, and access to all other information and documents is achieved by submitting an oral or written request.

The right to access information and reuse of information is exercised by submitting a request to the Municipal Information Officer. Milna in the following possible ways:

Fee for access to information

The Municipality of Milna has the right to compensation for actual material costs incurred in providing information to the beneficiary of the right to access information and reuse of information, as well as for compensation for the costs of delivering the requested information, which is charged in accordance with the Criteria for Determining the Amount of Compensation for Actual Material Costs and Costs of Delivering Information (hereinafter referred to as: the Criteria) pursuant to Article 19, paragraph 2 of the Right to Access Information Act (Official Gazette, No. 25/13).

The amount of compensation for actual material costs is determined as follows:

1. copy of one A4 page – 0.25 kuna
2. copy of one A3 page – 0.50 kuna
3. one page color photocopy, A4 size – 1.00 kuna
4. one page color photocopy, A3 size – 1.60 kuna
5. electronic recording on one CD – 4.00 kuna
6. electronic recording on one DVD – 6.00 kuna
7. electronic recording on a memory card depending on the amount of memory – 210 kuna for 64 GB, 150 kuna for 32 GB, 120 kuna for 16 GB, 50 kuna for 8 GB, 30 kuna for 4 GB.
8. converting one page of a document from physical to electronic form – 0.80 kuna
9. converting a record from a videotape, audiocassette or diskette into an electronic record - HRK 1.00

The costs of delivering information are calculated according to the valid price list for regular postal services.

REMARK:

The amount of compensation for actual material costs for services not specified in the Criteria is determined by the public authority by including in the amount of the compensation the average market price for the service, the depreciation cost incurred by the public authority and the cost of postal services. The costs of delivering information are calculated according to the valid price list of postal services. The user of the right to information must deposit the expected amount of actual material costs in advance in full. In the event that the user of the right to information does not deposit the specified amount within the deadline, the user of the right to information will be deemed to have withdrawn the request. The Municipality of Milna will issue the user of the right to information an invoice according to the amount of compensation specified in the Criteria.
